Ways to Avoid Probate

There are several ways in which to avoid probate and minimize costs. At the Law Offices of Jasleen K. Anand, we advise clients on the following options:

  • Revocable trusts — A revocable trust is a type of trust that can be changed or modified at any time. Revocable trusts can be incorporated into a will. Our attorneys can advise you on revocable and other living trusts.
  • Joint tenancy, ROS — In joint tenancy with right of survivorship, property is automatically transferred to the surviving spouse after the other spouse's death. Joint tenancies are used when couples own assets together: Real estate, vehicles, bank accounts, etc.
  • Lifetime gifts — By giving away gifts during life, the gifts are removed from the final estate and avoids probate.
  • Retirement accounts — IRAs, 401Ks, and other retirement accounts are not subject to probate after a death. Instead, the beneficiary of these accounts receives the money after the account holder's death.

The key to avoiding probate is proper planning. Our attorneys can help you identify ways in which you can avoid probate, minimize estate taxes, and lessen the burden on your family after your death.

We also provide culturally-sensitive estate planning services to individuals of Eastern religions and cultures.
